Worker Agreement
Waka Care Solutions • Kampala, Uganda • legal@wakahelper.com
This Worker Agreement applies to all individuals who register on WakaHelper as a Worker — including house helpers, nannies, cooks, caregivers, gardeners, drivers, and all other domestic service providers. It supplements our general Terms of Service, which you must also read and accept.
By creating a Worker profile or submitting an application through the Platform, you confirm that you have read and agree to this Agreement.
1. Your Relationship with Waka Care Solutions
You are not an employee, agent, or contractor of Waka Care Solutions. We operate the platform that connects you with potential Employers. We do not pay your wages, direct your work, supervise your performance, or carry employer liability for any work you perform.
Any employment or service relationship you enter through WakaHelper is between you and the Employer only. You are free to negotiate your own terms, accept or decline any offer, and work for multiple Employers simultaneously unless your employment contract states otherwise.
2. Accurate Profile Information
You must ensure that your profile is honest and accurate at all times. You must not:
- Misrepresent your skills, qualifications, or years of experience;
- Claim certifications or training you have not completed;
- Use photographs of another person as your profile photo;
- Misrepresent your location or availability; or
- Create a profile on behalf of another person.
Providing false information on your profile is grounds for immediate account suspension and may constitute fraud under Ugandan law.
3. Prohibition on Upfront Payment Demands
You must never request, solicit, or accept any money from an Employer as a condition of submitting your application, appearing for an interview, or securing a placement. This is a fraudulent practice that harms vulnerable job seekers and will result in immediate permanent account ban.
Note: If any Employer asks you to pay a fee to consider your application, this is a scam. Report it immediately via the flag/report function or email trust@wakahelper.com.
4. Identity Verification
To apply for the WakaVerified badge, you must submit your identity documents (National ID or passport) through the secure document upload in your Settings. By doing so you explicitly consent to:
- Waka Care Solutions staff reviewing your document for identity verification purposes only;
- Your document being stored securely on our systems for a maximum of 90 days following the verification decision; and
- Your identity number being stored encrypted in our database for the lifetime of your account.
You warrant that the documents you submit are genuine and belong to you. Submitting forged, altered, or stolen identity documents is a criminal offence under Ugandan law and will result in permanent account suspension and a report to Uganda Police.
5. Criminal Convictions
You must disclose to Waka Care Solutions any criminal conviction you have received for an offence involving violence, theft, fraud, child abuse, sexual assault, or any offence against a vulnerable person. Failure to disclose a relevant conviction, which later comes to light, will result in immediate account termination.
Disclosure should be made by emailing trust@wakahelper.com. We treat disclosures with discretion and will assess each case individually before making an access decision.
6. Your Rights as a Worker Under Ugandan Law
Once engaged by an Employer, you have legal protections under Uganda’s Employment Act 2006, including:
- Written contract: Your Employer must provide a written employment contract within one month of commencement.
- Minimum wage: You are entitled to be paid at least the prescribed minimum wage.
- Annual leave: Not less than 21 working days paid leave per year after 12 months of service.
- Sick leave: Paid sick leave as provided by the Act.
- Notice: Your Employer must give you adequate notice before termination (typically one month for monthly-paid Workers).
- NSSF: If you work more than 22 hours per week, your Employer is legally required to make contributions to the National Social Security Fund on your behalf.
- Safe working conditions: Your Employer must provide a safe workplace free from physical and psychological abuse.
If an Employer violates your rights, you can report it to the Ministry of Gender, Labour and Social Development(Labour Office) or seek advice from the National Organisation of Trade Unions (NOTU).
7. Freedom to Withdraw
You have the right to withdraw your application at any time before you sign a formal employment contract. Once a contract is signed, your rights and obligations are governed by that contract and the Employment Act 2006. WakaHelper will not penalise you for withdrawing an application.
8. Right to Leave a Job
If you are in an employment situation that involves abuse, withheld documents, non-payment of wages, or any unsafe condition, you have the right to leave and seek help. Contact the Platform at trust@wakahelper.com for support and signposting to relevant government agencies.
9. Profile Visibility and Privacy
By creating a Worker profile you agree that your profile — including your name, photo, bio, skills, location, and salary expectations — will be visible to Employers browsing the Platform. Your contact details (phone number, email) are never shown publicly and are only accessible to Employers who have paid the PP Unlock fee.
Your identity document images and numbers are never visible to Employers on the Platform.
10. Reviews
Employers who have engaged you may leave a review on your profile. Reviews must comply with our Review Policy. You may flag reviews you believe are false, malicious, or in violation of our policies.
